COMBERBACH Parish Council will have to answer to the High Court over the use of the village’s memorial hall.

Mark Williams, of Barrymore Crescent, applied for a judicial review to look into the running of the hall in the village.

He received nearly 60 emails from Comberbach villagers supporting his stance in seeing the hall open more frequently, in particular on Sundays.

At the July meeting of Comberbach Parish Council, Clr John Jefferson, said that the council had no role in the running of the hall.

He said the council was ‘prohibited from interfering with the management’ and that the council was ‘not involved’ with the memorial hall committee.

But this is something that Mark and a proportion of the village disputes.

As a result, the judicial review was submitted and the parish council has been sent a 86-page document from the High Court.

The council has 21 days in which it can respond.

Mark said: “We are challenging the council’s refusal it has no control of the running of the memorial hall either by financial or otherwise.

“They have to reply to this document but they did not reply to the pre-action protocol so what lawyers are telling me is that their chances of winning are minimal.

“A justice will decide it and if it is decided in my favour then we would go back to the parish council and ask them to take control and if they don’t then we would have to go back to the court.”

At the time the Guardian went to press Comberbach Parish Council had declined to comment.
