A DRIVER refused to do a breathalyser test after being run over.

Andrew Thompson, of Broadway in Barnton, has been disqualified from driving after admitting to using an uninsured vehicle and failing to provide a specimen for analysis.

It comes following a road rage incident in Northwich on July 18 involving Thompson and another man.

Cheshire Police say Thompson had got out of his vehicle, a blue Ford Fusion, to engage in a ‘verbal altercation’ following a near-miss close to KFC on Chester Way.

He ended up getting hit by the other person’s vehicle twice, suffering a head injury.

The 37-year-old said he did not remember getting out of his vehicle, however, multiple bystanders said they had seen him driving immediately before the incident.

Thompson was treated at the scene by an ambulance crew before being breathalysed as part of the standard road traffic collision procedure.

He blew a reading of 94 microgrammes of alcohol in 100ml of breath, the legal limit being 35.

Thompson was formally arrested at 3.40pm and taken to Leighton Hospital to receive treatments for his injuries.

He was later taken to Middlewich Custody Unit, where the ‘evidential' breath test procedure began at 8.35pm.

There, he refused to provide an evidential sample of breath, despite being informed by officers that this would result in a charge.

To this, Thompson repeatedly stated ‘I refuse and request bloods’.

Police also found that his vehicle was not insured at the time of the incident.

An 83-year-old man from Macclesfield was also arrested at the time of the incident, on suspicion of wounding with intent.

Thompson appeared at Chester Magistrates Court on November 22 where he was handed a 12-month community order and banned from driving for 20 months.

As part of this he must complete six months of an alcohol treatment course and 30 days of rehabilitation activity.

He will also have to pay a £276 fine along with costs of £85 and a £114 surcharge.

Cheshire Police confirmed the investigation against the Macclesfield man is ongoing.
