A WINSFORD man suspected of drink-driving has been handed a suspended jail term after refusing to take a breathalyser test.

Daniel Curzon, of Wharton Road, was taken to the Middlewich Custody Suite on August 10 earlier this year after being suspected of having driven a vehicle while impaired.

But, on October 8, Crewe Magistrates Court heard the 41-year-old 'deliberately refused' to provide a specimen of his breath for analysis.

Curzon was charged with the offence and pleaded guilty when he appeared in the dock on Tuesday.

The bench sentenced him to 12 weeks in prison, but suspended the term for 12 months.

Reasons for custody given by the court were the seriousness of the offence - meaning only a custodial sentence could be justified, Curzon's 'high level of impairment' and his previous record.

But magistrates felt the sentence could be suspended due to the defendant having a realistic prospect of rehabilitation.

Curzon was also disqualified from driving for four years, but this could be reduced by 48 weeks if he completes a rehabilitation course by September 6, 2027.

Magistrates also ordered him to abstain from alcohol for 90 days and complete up to 10 days of rehabilitation activity.
