New divorce laws came into force in England and Wales on the 6th of April 2022 allowing couples to end their marriage jointly and to proceed without alleging fault.
Some people now have chosen to take advantage of the simplified process and issue divorce proceedings themselves online. However, there is a misconception that just by obtaining a divorce that means everything is resolved between a couple including all financial arrangements.
The law says unless you take steps to resolve financial matters formally claims can be made even many years into the future. Any financial agreement should be in the form of a Consent Order which is a formal Order approved by the Court.
